🔐 Introduction

Welcome to TYA Crew Placement, the recruitment arm of The Yachtie Academy. We offer high-integrity, boutique crew placement services for yachts and private households worldwide.

This page is a plain-English overview of the terms and conditions you agree to when working with us. It’s designed to help you understand what happens at each step — and why we do things a little differently than big-name CV databases.

💼 When Do These Terms Apply?

These terms apply from the moment you instruct us to begin recruitment — whether through a form submission, email, WhatsApp, or call.

  • Filling out our intake forms
  • Paying your engagement fee
  • Requesting profiles or candidates

Even if you haven’t signed the full agreement yet, using our services constitutes acceptance of these terms.

💸 Why Is There an Engagement Fee?

To begin recruitment, we require a €500 non-refundable deposit. This confirms you’re serious, protects our time, and ensures our team prioritizes your role.

✅ This deposit is credited against your final placement fee.
🕒 Need to cancel? You may be eligible for a refund within 48 hours, provided recruitment hasn’t started and Form 2 (Quick Crew Brief) hasn’t been submitted. See Refund Policy for full details.

📁 When Will I See Candidate Profiles?

We start sourcing as soon as your brief is submitted, and in urgent cases, we often begin behind the scenes while paperwork is still being reviewed.

However, we only share candidate profiles after we receive:

  • ✅ Your signed contract
  • ✅ Your €500 engagement fee (or proof of transfer)

This ensures confidentiality and protects the candidates’ privacy — it’s a core part of how we operate.

🔁 What If the Hire Doesn’t Work Out?

We offer a 60-day replacement guarantee in the event a candidate resigns or departs unexpectedly, as long as:

  • You’ve paid the invoice in full within 30 days
  • You notify us promptly and in good faith

We may offer a further replacement or a credit note at our discretion. If a candidate is dismissed without cause, the guarantee does not apply.

💰 What Are Your Placement Fees?

Our fees are simple and fair:

  • Permanent roles: One month of the candidate’s salary
  • Short-term roles (90 days or less): One-third of total salary (incl. travel days)
  • Multiple placements: Full rate for first hire, 75% for additional hires in the same cycle

No surprise add-ons. VAT may apply depending on your location.

📜 Can I Share Candidate Profiles With Others?

No. All profiles, communication, and candidate data are strictly confidential.

Sharing our candidates’ information with third parties (e.g. other agents, owners, management) without written permission is a breach of contract and may result in full placement fees being charged.

🛂 Who’s Responsible for Travel and Legalities?

You are. As the employer, you are fully responsible for:

  • Visas and work permits
  • Flag/state compliance
  • Medical and repatriation coverage
  • Crew travel costs (to/from vessel)

We can advise, but the legal and logistical responsibility always sits with the client.

⚖️ What Law Governs This Agreement?

Our services and contract are governed by French law. Any disputes will be handled via the Commercial Court of Nice.

We rarely need to escalate things — our reputation and transparency make that a last resort.

💾 How Do You Handle My Data?

We comply fully with GDPR and French data protection laws. Any data you share — from your contact details to crew contracts — is stored securely and only used to facilitate placements.
